Any use of its members’ repertoire for training, development, or implementation of AI models requires explicit authorization and fair compensation. Unlicensed training of AI models on copyrighted works not only infringes on artists’ intellectual property but also jeopardizes their livelihoods and those who collaborate with them.
Merlin acknowledges the potential of AI to enhance creativity, provided it is developed responsibly and collaboratively. They are open to partnering with AI companies that respect artists’ rights and operate within clear ethical frameworks. However, they firmly oppose any product benefiting from independent music repertoires without permission, deeming such practices morally and legally unacceptable.
The organization also refutes the notion that unlicensed AI training constitutes “fair use.” According to Merlin, these practices fail to meet the legal criteria for fair use, as they harm the market for original works by creating competing products.
Merlin’s position sends a clear message: independent music is a cultural and economic cornerstone deserving protection. As AI evolves, the independent community, with Merlin leading the charge, will continue to advocate for the irreplaceable value of human creativity.
